The Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) protects employees of a business being transferred, provided certain criteria are met. Effectively they retain all of the rights they had prior to the transfer and are subject to the same terms and conditions of employment.

We will ensure that your business is not adversely affected by any transfer by offering advice in respect of the application of TUPE to business transfers, including the obligations of the transferee/transferor to inform and consult, the effect of the transfer on contracts of employment, the issues associated with dismissal or redundancy of employees affected by the transfer and drafting any necessary warranties and indemnities to protect your business following the due diligence process.
