Restrictive Covenant Disputes

Employment contracts for often contain restrictions designed to protect your business in the event the employee moves on, particularly in the case of senior employees. Potential risks to your business may include the employee setting up business in competition or attempting to poach staff. These risks can usually be covered by restrictive covenants that will remain in force for a set period of time following termination of the employment contract.

If it becomes apparent that your former employee is in breach of those restrictions, you may be entitled to damages for any loss your business suffers as a result of the employee’s actions.

We will provide clear and commercial advice on the course of action that is right for the needs of your business which may include the issue of High Court injunctive proceedings.
